Zakat ul-Fitr

Excellent praise and gratitude are due to Allaah Subhanahu Ta^ala, the one who is in neither a state of movement nor immobility nor is He a tangible or intangible entity, the one who has no colour or direction and is free from all imperfection, the one who is not confined and who cannot be conceived with the mind, the one who is not bound to time and does not descend or cline, the one who is attributed with life unlike our life and who has neither son nor wife, the one who is neither a body nor figure and He is not equal in volume to the throne nor smaller nor bigger, the one who existed eternally and alone when there was neither water nor throne, the one who has created the throne as a sign of His absolute power and He is not inclined towards upper or lower, the one who has created volume and space, the one who exists without manner or place, the one who has created morning and night, who is free from being similar to darkness and light,  the one whose reality  (dhatullaah) does not resemble anything, nor does anything resemble Him, He does not need anything and everything is in need of Him, the one who guided us to this for we would never had been guided to it  if He never had not guided us to it

We start in the name of Allâh and we ask Allâh to raise the rank of our dear Prophet MuHammad sallalahu ^alayhi wassalam, and to protect his nation from that which he feared for it

Bismillah-ir-Rahman-ir-Rahim


Insha'Allah we start with the chapter of zakah and move into the chapter of fasting

Chapter of zakah 

Zakah is a duty-wajib- on camels, cows, goats and sheep and there is no zakah on horses according to the two companions. And cereals and other products of the earth, then gold, silver and the rikaaz ((treasure buried at the time of jâhiliyyah)) and jewels from them ((i.e from gold and silver)) and trading goods and fiTr ((zakaha lfiTr)), the first niSaab for camels is five (()) as for the cows it is 30 heads and as for sheep and goats it is 40 there is no zakah beneath that level and one must wait for one year after reaching this number and they must have grazed in public land/pasture most of the year and they should not be working animals ((includes camels, cows or oxon which are used for work))  used to plough the ground or to do similar work-no zakah is used on it.



Two companions here refers to the two companions of Imam Abu Hanifa

It is wajib for every 5 camels to pay a shah ((1 yr old ewe or a 2 year old goat)) and for 40 sheep and goats you also pay a shah and for 30 bovines you pay a 1 year old calf and if you have more then that he should pay the extra that he owes. It is a duty upon a person to learn what Allâh has imposed upon him to pay for these animals ((if he has more then the numbers mentioned, it is a duty upon that person to learn about it in more detail))

As for cereals and other products of the earth, whether there is little or a lot, zakah is due upon it according to the Imam. The two companions said, it is a pre-requisite that the niSâb should be reached and the first niSab is five wasq’s** which is 300 sa^ by the standard of the sa^ of the prophet (Salla-llâhu ^alayhiwasallam).  And it is a pre-requisite also that its fruit, can be kept for a whole year without effort nor treatment ((fruit here means part of vegetable that can be eaten i.e for wheat only the grain can be eaten)) and there is no zakah according to them ((the two companions)) on plants and fruits ((plants are things like parsnips etc what you pay zakah for are the staple foods i.e do not take plants like green beans into account. As for fruit this here refers to normal fruit i.e apples. 2 words for fruit are thamarah, generic: thamr and and fâkihah, pl: fawâkih ))


**wasq pl: 'awsuq (wasq is big bag put on side of a camel, 5 wasq's is put on each sides and they make up 300 sa^)

And we add cereals one to another in order to complete the niSab but you do not complete one species with another species such as barley and wheat. And zakah is due when the plant has reached a state where it can be eaten  i.e you dont pay zakah on wheat when it is green and cannot be eaten, it is a duty to pay on it a tenth if they have not been irrigated with equipment and half of this is if it has been and what is beyond the niSab you pay for it in proportion. ((Equipment to bring the water to their plant, then they only pay half of a 10th = 20th. )) As for gold its niSab is 20 mithqâl’s ((another word for dinaar)) and for silver its niSab is 200 dirhams.
it is wajib to pay on both of them i.e gold and silver, a quarter of a 10th ((a quarter of a tenth= 2.5%)) and what is above the niSab is included in the calculation according to the two companions. As for the imam according to him nothing is due to what is above the first niSab until it reaches 40 dirham of silver and 4 mithqaal's of gold and a whole year needs to go past.

What is found in mines of buried treasures going back to the time of jaahiliyyah, in land on which the tithe (a tenth of the harvest) or khiraaj (land belonging to the Islamic state and is rented by people) is paid on them [a land which belongs to the Islamic state and which is rented by people, so they pay the Islamic state what is called the khirâj] i.e. Islamic lands [dâru l'Islâm], then zakâh is paid on them (i.e. the 2 things) immediately and what is paid on them is the 5th and the rest belongs to them.
If a person finds in his property a source of those two metals he does not pay anything and if he finds a treasure which has on it the sign of Islam ((i.e coins which have on it name of a muslim sovereign)) it is treated as a lost object.
As for zakah on trading good its niSab is the niSab of gold and silver and it is not taken into account until a whole year has gone past and it is wajib to pay on them a quarter of a 10th of their value. It is not wajib to pay zakah on a niSab reached by putting together different elements, whether it is grazing animals or trading goods, if the niSab is reached by putting them together
It is wâjib to pay zakatulfitr when the fajr of the day of ^id happens, for every free Muslim on himself, on his small children, and on those who are insane and poor. And on his working slave even though they are kuffar and for every person he pays half a sa^ of wheat or one sa^ of dates or raisins or barley, if he already owes the niSaab, excluding his debts accommodation, furniture, horse, weapon, his working slaves and what people he is in charge of by obligation need, and it is permissible to pay the value of this.
