NikaH fiqh, according to the Hanafi madhhab

From the language point of veiw, nikaH is uniting.  From the shar^ point of view it is a contract (^aqd)whose purpose is to allow enjoying each other. 

i aim to continue this 'in shâ'a-llâh, keep me in ur du^âs :-D

nikaH takes place by a response (someone comes to ask for the girls hand in marriage, and responds by giving the girl away) and an acceptance (the marriage becomes valid by the bridegroom by saying "i accept with this dowry")

i forgot to start in the name of Allâh  :oops: (may Allâh forgive me)

bismi-llâhi raHmân irraHîm, walHamduli-llâhi rabbi l^âlamîn, waSalla lâhu ^ala sayyidina muHammad wassallam, ûsikum wanafsi bitaqwa-llâh, an yarzuqna Husnan niyyah. (corect me if my arabic is wrong please)

i start in the name of Allâh subHanahu wa ta^âlâ, the Lord of the worlds, to whom belongs the blessing and endownments. i ask Allâh to raise the rank of our beloved MuHammad, Salla lâhu ^alayhi wassallam, his brothers in Prophethood, his hounarable 'âl, his noblest companions. and i ask Allâh to protect the nation of muHammad from that which he feared for it.  i remind myself and u to fear Allâh, and i ask Allâh to grant us the good intention, i.e a pure intention. 'âmîn 

nikaH
this is done:
By using 2 phrases which are expressed in the past tense, (in arabic), or one of them is expressed in the past tense and the other one in the unaccomplished (both present, future) tense

such as saying (zawwajni, zawwwaj - married, ni - me), get me married, the other answers zawajtuka (i have gotten you married)

the nikaH contract of two muslims is not realised until 2 free, adult, sound of mind muslim witnesses (they should both together hear their words, understand them) attend.  or 1 male and 2 females, whether they are ritious or not, or even if they have been punished for qadhf (excusing somone of fornication without proof) (even if they are blind or the children of the couple, or the children of one of the couple)

 if a muslim marries a dhimmiyyah (people who pay jiziyah in an islamic country) with 2 dhimmiyys as witnesses, it is valid acording to Abû Hanîfah and Abû Yûsuf (a companion of Abû Hanîfah), but muHammad (another companion) said it is not valid.  (it is said that the first opinion is the correct one - SaHiH)

i have a question,. does anyone know how to translate jiziyah in english?
