As-salaamwalaikum to all....

To what extent may a sister who has been married before, have a say so concerning a possible marriage? Exactly what role does the Wali have in assisting her, and where does his role end?
Seeking Nasiah on this matter, according to Qur'ran and  sound Hadiths.

wa 3alaikom assalaam wa raHmatullaah

There is a Hadeeth of the Prophet that gives the meaning that for the validity of the marriage contract, the waliyy and the witnesses are required.

The waliyy's role is to say to the man who wants to marry the waliyy's daughter for example "I give my daughter so and so in marriage to you".

Hey can anyone help me out to know the conditions of the waliyy of the bride and the conditions of the witnesses according to Imaam Shaafi^i?

I lost my notes :( and i didn't store it in my mind :(

as far as I know female cannot be waliyy and there is details in it. This is according to Imam Ash-shafi^iyy. And also there is hadith that proofs it. Yes, I did that link longtime ago but no body was interested that's the reason i took off.

At what age can a sister consider herself pass the age for marriage?

I am almost 52yrs. years of age, and while I would like to be married, thus far Allah has not allowed it to happen. Since reverting to Islam some 10 yrs. ago I remain single. At what age am I allowed to somwhat lay my hijab aside? Or must I remain fully covered for the rest of my life as a sign of modesty?

I need nasiha on this matter.

Dear sis,

May Allaah give you patience.

The obligation of covering the ^awrah is not dependent on whether a woman gets married or not.

The ^awrah of the Muslim woman in front of a man who is not her mahram or her husband is all her body except her face and hands. According to the imaam Abu Haneefah her feet are not ^awrah.

The man's awrah in front of everyone except his wife is between the navel and the knees.

That is what Islam says and Allaah is Just.

Alhumdulillah, Sister I am aware of your statement, but also in the english transliteration of the Qura there is a ayat, that says something to the effect, that when a woman is pass the age of marriage, then there is no blame on her if she lays aside her hijab, as long as she does not make a obvious display of herself...now, this is not a quote, but it's there.... so this is what I was eluding to. Insha-Allah, I will take more time to find that precise ayat as soon as possible, unless someone that knows it's whereabouts will kindly post it???
I have every intentions of keeping myself Islamically covered, but as far as marriage is concerned...I kinda have thrown in the towel so to speak, but I am always conscious of the fact that only Allah knows all things known, and unknown.
