« on: Friday 27 October 2006, 07:46 »
Aselamualeykum

A women who had nikah with her husband who lives abroad and they do not have sex.And she want to make nikah with the new guy after getting divorce. Here waiting muddah is neccessary becouse they donot touch each other?
The 2nd question is that if a person say something which may breack nikah to his wife but he is confused
about it and to be in posetive corner he said to his wife i returned you to my nikah following the peocedure . So suspicion or shek whether divorce is made or not can make the nikah in to question?
Again, if a person taking to himself about his tilaq like weswas not say any thing on his mouth, he just imagine saying teleqyu with the intention what disaster if i said so? How about his nikah?

wa 3alaikom assalaam brother Abdunasir,

welcome to the forum.

For your first question, no there is no ^iddah that the woman must wait if her husband divorced her and he had never had intercourse with her.

For your second question, what was the word that the man said to his wife?

If that man said a word to his wife such as "go back to your parents house" with the intention of divorce then the divorce happens.

For your third question, I havn't heard of it before, but I'm pretty sure someone else will know, in any case I will ask for you in shaa' Allaah.

For your third question, just thinking about divorcing your wife does not affect your marriage contract.
